These Terms of Service (“Terms”) govern your access to and use of bestretreats.co (the “Site”) and any related services provided by The Retreat Safety Project, Inc. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Who We Are

The Site is operated by The Retreat Safety Project, Inc. (“we,” “us,” or “the nonprofit”), a Missouri nonprofit corporation recognized by the IRS as a tax-exempt public charity under Section 501(c)(3). EIN: 41-5114645.

The nonprofit operates the Best Retreats public retreat directory, the Best Retreats Accreditation program, the incident reporting service, and related research and educational content available on the Site.

2. Eligibility

You must be at least 18 years of age to use the Site. By using the Site, you represent that you meet this requirement and that your use of the Site does not violate any laws applicable to you.

3. Nature of the Site and Information Provided

Best Retreats is an independent research and consumer-protection resource. The Site provides:

  • A public directory of ayahuasca and plant medicine retreat centers, including independently determined trust grades and listing content
  • Educational content related to retreat safety, harm reduction, and screening
  • An incident reporting service for participants and witnesses
  • An accreditation program for retreat operations that voluntarily participate
  • Related research and editorial content

The Site does not facilitate retreat bookings, process payments to retreat centers, or operate as a travel agency. Any decision to attend, book with, or contract with any retreat center is made directly between you and that retreat center.

Information on the Site is provided for general informational and educational purposes only. It is not medical advice, mental health advice, legal advice, or professional advice of any kind. Ayahuasca and plant medicine ceremonies may carry serious physical and psychological risks. Consult qualified professionals before participating in any retreat or ceremony.

4. Trust Grades and Independent Research

Trust grades, listing content, incident reports, and related research published on the Site reflect The Retreat Safety Project’s independent evaluation based on publicly available information, user-submitted reports, and our research methodology. This research is published in good faith and represents our reasonable assessment based on the evidence available to us at the time of publication.

Retreat centers and other parties who believe a listing contains factual inaccuracies may contact us at contact@bestretreats.co to provide additional information or documentation. We will review submissions and update listings where evidence warrants.

Participation in the Best Retreats Accreditation program does not influence trust grades, which are determined independently regardless of accreditation status.

5. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, defamatory, or malicious information through any form or contact channel
  • Attempt to disrupt, damage, or gain unauthorized access to the Site or its infrastructure
  • Use automated tools (bots, scrapers, crawlers) to extract content from the Site without our written permission
  • Reproduce, republish, or commercially redistribute Site content without authorization
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Submit incident reports that you do not believe in good faith to be accurate

6. Incident Reports

The Site provides a public incident reporting form for users to submit information about retreat experiences. By submitting an incident report, you represent that:

  • The information you provide is accurate to the best of your knowledge
  • You are submitting the report in good faith for the purpose of consumer safety
  • You grant us the right to use the report for our research, including the right to publish information derived from the report consistent with our published practices

You may submit incident reports anonymously or with identifying information. If you submit anonymously, we may not be able to follow up with you. If you provide identifying information, we will not disclose your identity to the retreat center named in the report without your explicit permission, except where required by law.

We may publish information based on incident reports, including aggregated patterns of complaint and individual incident notes on retreat listings, in accordance with our research and accreditation enforcement processes. Where we publish information based on a specific report, we will not identify the reporter unless they have explicitly authorized identification.

We reserve the right to decline to investigate, publish, or act on any submission at our discretion.

7. Accreditation Program

The Best Retreats Accreditation program is a fee-based program available to retreat operations that meet our published Accreditation Standards. Specific terms of accreditation, including fees, obligations, and grounds for suspension or revocation, are agreed to in writing between The Retreat Safety Project, Inc. and each accredited center at the time of enrollment.

Participation in the accreditation program does not create a partnership, joint venture, employment relationship, or agency relationship between the accredited center and the nonprofit. Accredited centers remain solely responsible for their own operations, services, safety practices, and legal obligations.

8. Donations

Donations to The Retreat Safety Project, Inc. are accepted as charitable contributions to a 501(c)(3) tax-exempt organization. Donations are non-refundable except as required by law. Donations support the nonprofit’s mission and may be used for any lawful purpose consistent with that mission. Tax deductibility is subject to applicable law and your individual tax circumstances.

9. Third-Party Sites and Services

The Site contains links to third-party websites, including retreat center websites, research organizations, and external resources. We do not control these sites, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of third-party sites is governed by their own terms and policies.

10. Intellectual Property

The Site, including its design, code, text, graphics, logos, methodology documentation, and other content, is owned by The Retreat Safety Project, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and reference Site content for personal, non-commercial purposes. You may not reproduce, republish, distribute, or create derivative works from Site content without our prior written permission, except as expressly permitted by law.

User submissions, including incident reports and other content you submit through the Site, may be used by us as described in these Terms. By submitting content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, publish, and create derivative works from your submission for purposes consistent with the nonprofit’s mission.

11. Copyright Complaints

The Retreat Safety Project, Inc. has registered a designated agent under the Digital Millennium Copyright Act for receiving copyright infringement notifications. Our DMCA registration number is DMCA-1072205. You can verify our DMCA registration at the U.S. Copyright Office DMCA Directory.

To submit a notice of copyright infringement, send the following information to the designated agent:

We will respond to valid notices in accordance with the DMCA and applicable law. We may also forward the notice to the user who posted the material.

Misrepresentations in DMCA notices may result in liability for damages under 17 U.S.C. § 512(f).

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any information on the Site, including listings, trust grades, or incident reports.

You acknowledge that decisions about retreat participation involve significant personal risk and that you are solely responsible for your own decisions and their consequences.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RETREAT SAFETY PROJECT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING WITHOUT LIMITATION DAMAGES RELATED TO RETREATS YOU CHOOSE TO ATTEND, INFORMATION YOU RELY ON FROM THE SITE, OR THIRD PARTIES YOU INTERACT WITH AS A RESULT OF YOUR USE OF THE SITE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Retreat Safety Project, Inc. and its officers, directors, employees, volunteers, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any content or information you submit through the Site.

15. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Site will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, and governing law.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and post the revised Terms on this page. Material changes will be communicated through the Site or directly to known contacts. Your continued use of the Site after the effective date of any revision constitutes your acceptance of the revised Terms.

17. Future Operational Changes

The Retreat Safety Project, Inc. may at its discretion delegate or transfer specific services on the Site to affiliated entities, partners, or successors, including any future for-profit or related organizations established to support specific functions. If such a change occurs, these Terms will be updated to reflect the new operational structure.

18. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Missouri, and you consent to the jurisdiction and venue of such courts.

If you are located outside the United States, you acknowledge that you are using a service operated from the United States and consent to U.S. law governing your use of the Site.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any agreements specific to particular services (such as accreditation agreements), constitute the entire agreement between you and The Retreat Safety Project, Inc. regarding the Site and supersede any prior agreements.
